1. Acceptance of these terms
These Terms of Service ("Terms") form a binding agreement between you and New Quest AI Inc. ("Quest", "we", "us", or "our") governing your use of the Quest application and the website at new.quest (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The service
Quest provides AI-powered assistant software and related services. With your permission, the Service connects to third-party services you choose to link. The Service is provided on an ongoing basis and may evolve over time; we may add, change, or remove features.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and that you have the legal capacity to enter into these Terms.
4. Accounts and connected services
You create and access your Quest account through iMessage, using a third-party messaging provider. Your phone number serves as your account identifier. You are responsible for all activity that occurs under your account, and you agree to notify us promptly of any unauthorized use.
To provide its features, Quest connects to your Google Account to access the data described in our Privacy Policy, and may let you connect other third-party services to give it more context. You can disconnect a connected service, or revoke its access, at any time.
5. Acceptable use
You agree not to:
- Use the Service in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or attempt to extract source code, except as permitted by law.
- Use the Service to infringe the rights of others, or to access data you are not authorized to access.
6. Third-party services
The Service integrates with third-party services, including the services you connect, our messaging provider, and the service providers described in our Privacy Policy. Your use of those services is subject to their own terms and policies. When you connect your Google Account, you also agree to Google's applicable terms. We are not responsible for third-party services and do not control them.
7. Nature of AI output
Quest uses artificial intelligence to generate suggestions, summaries, and guidance. This output may be inaccurate, incomplete, or otherwise inappropriate for your situation, and is provided for general informational purposes only. Quest is not a substitute for professional advice — including medical, legal, financial, or mental-health advice — and you should not rely on it as such. You are responsible for evaluating the output and for any decisions you make based on it.
8. Your data and privacy
Our collection and use of your information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
9. Intellectual property
The Service, including its software, design, and content (excluding your data and content you provide), is owned by New Quest AI Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use in accordance with these Terms. You retain ownership of your own data and content.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any output will be accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by law, New Quest AI Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
12. Indemnification
You agree to indemnify and hold harmless New Quest AI Inc. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Upon termination, the provisions of these Terms that by their nature should survive will continue to apply.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.
15. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.
